These Terms of Service ("Terms") govern your access to and use of Birdor's websites, tools, APIs, and any related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms.
This document is provided for information and product usage purposes only and does not constitute legal advice. If you are running Birdor or similar services as a business, please consult your own legal counsel to adapt these terms to your jurisdiction.
1. Acceptance of Terms
By accessing or using the Services in any way, you agree to be bound by these Terms and all additional policies referenced here, including our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.
2. Changes to the Services and Terms
We may update the Services and these Terms from time to time to reflect changes in features, technology, or legal requirements.
- When we make material changes to the Terms, we will update the "Last updated" date above and may provide additional notice (for example, via the website or email, where appropriate).
- Your continued use of the Services after changes become effective constitutes your acceptance of the updated Terms.
3. Eligibility
You may use the Services only if you:
- are at least the age of majority in your jurisdiction, and
- have the legal authority to enter into these Terms on behalf of yourself or the entity you represent.
If you are using the Services on behalf of an organization, you represent and warrant that you have the right to bind that organization to these Terms.
4. Accounts and Access
Many Birdor tools can be used without creating an account. Some features or APIs may require registration.
- You are responsible for maintaining the confidentiality of any account credentials and for all activities that occur under your account.
- You must promptly notify us of any unauthorized use of your account or any other breach of security.
- We reserve the right to suspend or terminate accounts that violate these Terms or are otherwise used in an abusive or harmful manner.
5. Use of the Services
Birdor provides developer tools, utilities, and (in the future) APIs designed to assist with tasks like formatting, debugging, and inspection. You are solely responsible for how you use these tools and for any decisions or actions taken based on the output.
In particular, you understand and agree that:
- Many tools run entirely in your browser; where server-side Services are used, we aim to minimize data retention and access.
- Tools like formatters, debuggers, and inspectors are provided "as is" and should be used with care, especially in production or security-sensitive contexts.
- You are responsible for complying with all applicable laws, regulations, and third-party rights when using the Services.
6. Acceptable Use
You agree not to misuse the Services. In particular, you must not:
- Use the Services to store, process, or transmit content that is illegal, harmful, abusive, defamatory, or otherwise objectionable.
- Attempt to probe, scan, or test the vulnerability of any system or network, or breach or circumvent any security or authentication measures.
- Interfere with or disrupt the integrity or performance of the Services, including by sending excessive automated requests or attempting to overload infrastructure.
- Use the Services to create or distribute malware, spam, phishing campaigns, or other malicious content.
- Reverse engineer, decompile, or attempt to access the source code of any non-open-source parts of the Services, except where permitted by applicable law.
7. Intellectual Property
Unless otherwise noted, Birdor (or its licensors) retains all intellectual property rights to the Services, including but not limited to:
- the Birdor name, logo, mascot, and branding;
- the design and layout of the website and tools;
- original content, documentation, and guides;
- software, code, and APIs that power the Services.
You retain all rights to your own content and data that you process through the Services. We do not claim ownership over your input or output, subject to any specific API or integration terms that may apply.
8. Third-Party Services and Links
The Services may contain links to third-party websites, APIs, or services that are not controlled by Birdor. We provide these links for convenience only.
We are not responsible for the content, policies, or practices of any third-party services. Your use of third-party services is subject to their own terms and policies, not these Terms.
9. Disclaimers
The Services are provided on an “as is” and “as available” basis, without warranties of any kind, whether express or implied.
To the fullest extent permitted by law, Birdor disclaims all warranties, including but not limited to:
- warranties of merchantability, fitness for a particular purpose;
- warranties of non-infringement;
- warranties that the Services will be uninterrupted, secure, or free of errors or defects.
You use the Services at your own discretion and risk. You are solely responsible for any damage to your systems or loss of data that results from the use of the Services.
10. Limitation of Liability
To the fullest extent permitted by law, Birdor and its owners, operators, affiliates, and contributors will not be liable for any:
- indirect, incidental, special, consequential, or punitive damages; or
- any loss of profits, revenue, data, or business opportunities, whether incurred directly or indirectly,
arising from or in connection with your use of (or inability to use) the Services, even if we have been advised of the possibility of such damages.
Where liability cannot be excluded, our aggregate liability arising out of or relating to the Services will not exceed the greater of:
- the amount you paid (if any) for access to the specific Service in the twelve (12) months prior to the event giving rise to the claim,
- or a reasonable minimal amount defined by applicable law.
11. Indemnification
You agree to indemnify and hold harmless Birdor and its owners, operators, contributors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:
- your access to or use of the Services,
- your violation of these Terms, or
- your infringement or violation of any rights of another person or entity.
12. Privacy
Our Privacy Policy explains how we handle information when you use the Services. By using the Services, you agree that we can collect and use such information in accordance with the Privacy Policy.
13. Suspension and Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if we reasonably believe that:
- you have violated these Terms,
- your use poses security, legal, or operational risks, or
- the Services are being discontinued or substantially modified.
You may stop using the Services at any time. Some provisions of these Terms, by their nature, will survive termination (including ownership, disclaimers, limitations of liability, and governing law).
14. Governing Law and Dispute Resolution
These Terms and any dispute arising out of or relating to them or the Services will be governed by and construed in accordance with the laws of the jurisdiction in which Birdor is primarily operated, without regard to conflict of law principles.
Where possible, disputes will first be addressed informally. If a dispute cannot be resolved amicably, it shall be submitted to the competent courts of that jurisdiction, unless applicable law provides you with mandatory consumer protections that require otherwise.
